Video Downloader End user license agreement (EULA)

Video Downloader · Last updated:

This End user license agreement ("EULA") governs the installation and use of the Video Downloader extension for Google Chrome, developed by Lucas Genesses Dias Bittencourt (trade name Lucas Bittencourt), a sole proprietorship registered in Brazil under CNPJ 42.564.890/0001-04, located at Rua Expedicionário Benedito Vitoriano Siqueira, 44, Jardim do Vale, Guaratinguetá/SP, CEP 12519-370, Brazil (the "Licensor").

This is a translation. In case of any difference, the Portuguese version prevails.

This EULA covers the software itself: the license to use it, its intellectual property, and what can and can't be done with it. The account, payments and the Video Downloader Premium license are covered by the Terms of use, and data processing by the extension's Privacy policy.

1. Acceptance

To use the extension, you need to accept this EULA. Before any feature is available, the extension shows the notice Accept the Terms Of Service, with a link to this document and an Accept button. By clicking Accept, you confirm that you have read and agree to this EULA and to the Terms of use.

Your acceptance is recorded only in your browser's local storage, not on the Licensor's servers. That's why it's asked for again if you clear the extension's data, reinstall it, or use it in another browser or device, and also when a new version of this EULA is published.

If you don't agree to this EULA, don't click Accept, and uninstall the extension.

2. Definitions

  • Extension or Software: the Video Downloader extension for Google Chrome, in any version, including updates, fixes and the documentation that comes with it.
  • User or you: the person who installs or uses the Extension.
  • Third-party content: videos, audio, images, text and any other material available on the websites you visit or in the links you give the Extension.
  • Premium: the Video Downloader Premium lifetime license, sold separately and governed by the Terms of use.
  • Website: the lucasbittencourt.dev website, where this EULA, the Terms of use and the Privacy policy are published.

3. What the Extension does

The Extension finds the videos on the page open in your browser (video files and HLS or DASH streams), or the video of a link you give it, and lets you download them. Detection, stream assembly and downloads happen entirely in your browser. Files are saved by Chrome's download manager.

The Extension doesn't circumvent DRM, encryption, authentication, private content or any other access control. Content protected in these ways isn't downloaded. The Extension also doesn't guarantee that every video can be found or downloaded: that depends on how each website delivers its content, which may change at any time.

The current features are free and don't require an account. The account and Premium are optional.

4. License granted

The Licensor grants you a limited, personal, non-exclusive, non-transferable, free and revocable license to install the Extension in your browser and use it, under this EULA, for personal and lawful purposes.

The Extension is licensed, not sold. No rights are granted beyond those written in this EULA. Buying Premium extends what the Extension offers, under the Terms of use, but doesn't transfer ownership of the Software.

5. Restrictions

Except where the law expressly allows it, you may not:

  • copy, modify, adapt, translate or create derivative works of the Extension;
  • decompile, disassemble or reverse engineer the Extension, or try to obtain its source code;
  • sell, rent, lend, sublicense, distribute or publish the Extension, or modified versions of it, including in extension stores;
  • remove or change copyright notices, trademarks or other proprietary notices;
  • use the Extension to circumvent DRM, encryption, authentication, paywalls or other technical protections, or to access content you aren't entitled to access;
  • use the Extension in an automated or bulk way, or to overload, harm or break the rules of any website;
  • use the Extension to infringe third-party rights or applicable law.

6. Intellectual property

The Extension, including its code, design, text, name and brand, belongs to the Licensor and is protected by Brazilian Law No. 9,609/1998 (Software Law), Law No. 9,610/1998 (Copyright Law) and the applicable international treaties.

The Extension uses third-party open-source components, which remain governed by their own licenses. This EULA doesn't limit the rights those licenses grant for those components.

7. Downloaded content and your responsibilities

The Extension is a tool. The Licensor doesn't host, store, select, monitor or distribute the content you download, and has no knowledge of it.

You alone are responsible for what you download and how you use it. In particular, you must:

  • download and use only content you have the right to download and use, such as your own content, public-domain content, content under a license that allows downloading, or content you have the owner's permission for;
  • respect third parties' copyright, image rights and intellectual property;
  • respect the terms of use of each website where you use the Extension;
  • not use downloaded content for commercial purposes or redistribution without the owner's permission.

Downloading content with the Extension doesn't give you any rights over it.

8. Updates and support

The Licensor may update, change, suspend or discontinue the Extension, or any of its features, at any time, for example to fix errors, keep up with changes to websites or to the Chrome Web Store's rules, or comply with the law. Updates may be installed automatically by Chrome.

Problems and suggestions can be sent through the contact channels. The Licensor isn't bound to provide support or fixes within any set time.

9. Warranties

The Extension is offered free of charge, as is and as available. To the extent permitted by law, and without limiting consumer rights, the Licensor doesn't warrant that the Extension will work without interruptions or errors, that it's compatible with every website, or that it fits any particular purpose.

10. Limitation of liability

To the maximum extent permitted by law, the Licensor isn't liable for indirect damages, lost profits, data loss, or damages arising from downloaded content or from how you use it, nor for acts of third parties, such as the websites where the Extension is used.

This limitation doesn't apply to damages caused by the Licensor's willful misconduct or gross negligence, and doesn't remove the rights guaranteed by the Brazilian Consumer Protection Code or by any other rule that can't be waived by contract.

11. Indemnification

You agree to indemnify the Licensor for the losses and expenses, including reasonable attorneys' fees, arising from third-party claims caused by your use of the Extension in breach of this EULA, the law or third-party rights.

12. Privacy

This EULA doesn't cover personal data. How the Extension processes data, what stays in your browser only and what goes to the servers when you sign in or buy Premium, is described in the extension's Privacy policy.

13. Term and termination

This EULA applies while the Extension is installed. You can end it at any time by uninstalling the Extension.

The Licensor may end your license if you breach this EULA. When the license ends, for any reason, you must stop using the Extension and uninstall it. Clauses that by their nature should survive, such as those on intellectual property, liability, indemnification and governing law, remain in force after termination.

Ending this EULA doesn't affect the rights of a Premium license already paid for, which follow the Terms of use.

14. Force majeure

Neither party is liable for a failure caused by unforeseeable circumstances or force majeure, under article 393 of the Brazilian Civil Code, such as failures of third-party services, changes to websites or to Google Chrome beyond the Licensor's control, or orders from authorities.

15. Changes

The Licensor may change this EULA. The date of the last update is at the top of this page. When a new version is published, the Extension will ask for a new acceptance before making its features available. If you don't agree to the new version, you can stop using the Extension and uninstall it.

16. General provisions

  • This EULA, the Terms of use and the Privacy policy make up the entire agreement between you and the Licensor regarding the Extension.
  • If any clause is held invalid, the others remain in force.
  • Not enforcing a clause doesn't mean waiving it.
  • You may not transfer your rights under this EULA. The Licensor may transfer them in a reorganization or sale of the business, with your rights preserved.

17. Governing law and jurisdiction

This EULA is governed by Brazilian law. The parties will try to settle any disagreement amicably, through the contact channels. In consumer relations, the courts of the consumer's domicile have jurisdiction. In other relations, the courts of Guaratinguetá/SP, Brazil, have jurisdiction.
